Assessing the Operation of Copyright and Related Rights Systems

The project was financed by the Finnish Ministry of Education and Culture and it was carried out in English.

The methodology framework developed in the project consists of evaluation methods for analyzing

• the context in which the system operates,
• the functioning and performance of the different elements of the copyright system, and
• the operational balance of the copyright system as a whole.

The research methods included in the methodology framework are descriptive, quantitative or qualitative in kind.

The pilot phase of the project was carried out in 2013-2015. During the piloting process, the indicators specified in the methodology framework were put into practice in Finland. Altogether 37 reports presenting the results of the pilot phase are published in the web publication series of Cupore.

The assessment of a national copyright system’s operation will serve the formulation of copyright and related rights policies and strategies as well as the processes of developing the copyright and related rights system at the national level. It increases transparency and provides an information base for public discussion on copyright policy.

The methodology framework consists of relevant key indicators that are useful in recognizing trends and good practices while acknowledging the different contexts in which the national copyright systems operate. It is also useful in the assessment of the economic, cultural and social impacts of the copyright system and the realization of the principles of good governance.

The core project group comprised Project Manager Tiina Kautio and Researcher Nathalie Lefever. In addition, Project Researchers Milla Määttä and Jukka Kortelainen took part in the project during its pilot phase in 2013-2015 and in the final stage of the project in 2016. In 2013 pilot studies were carried out by a group of students from the universities of Helsinki, Jyväskylä and Turku. Researcher Mikko Karaiste worked as a member of the project group in 2010. The project was led by the consulting company Accenture for its initial five months’ stage in 2009. The steering group of the project comprised Marjo Mäenpää (Director of Cupore), Jukka Liedes (former Director at the Finnish Ministry of Education and Culture), Jorma Waldén (Director at the Finnish Ministry of Education and Culture), Jaakko Eskola (Ombudsman of Cupore), Pasi Saukkonen (former Director of Cupore) and Ritva Mitchell (former Research Director of Cupore). Copyright officials from the Finnish Ministry of Education and Culture have actively followed the project. A large group of international experts and representatives of different stakeholder groups have been consulted during the project. Contact was established with the secretariat of WIPO in order to better acknowledge the international aspects of the work and its possible international uses.
